1. Subjective and objective scope of service

1. General Terms of cooperation define the conditions upon which ArcusLink Professional Translation (the Contractor) renders services for the Customer. This document is biding providing that the parties have not signed a separate agreement regulating the terms of mutual cooperation.
2. The object of the service is to deliver translation or interpreting service ordered by the Customer.

2. Service procedure

1. Order for service realisation is placed by the Customer in writing:
- personally
- by post
- by fax
- in the form of an electronic message sent to biuro@arcuslink.pl, in case of prior filling and authorising by the Customer of the order form containing names of persons entitled to place electronic orders

Orders placed in other form than in writing may not be accepted by the Contractor.

In case when the Customer submits any materials, that are to be returned to the Customer after realisation of the service, deadline and form of such return of materials are set at the moment of placing an order.

2. Orders processed in the "standard time" of delivery are realised within 3 working days, if the volume of the text does not exceed 10 standard pages. Each following 10 standard pages under the same order are processed by the Contractor within 1 working day. For the orders processed in the standard time of realisation, the Contractor estimates the volume of the text and proposes an adequate deadline to the Customer.

3. Shorter time of order processing is individually agreed between the Customer and the Contractor. Each order in swift time of realisation is processed upon the request of the Customer expressed in writing (personally, by post, by fax or by electronic mail).

4. The price of the service is calculated basing on the current Pricelist, and calculation of the final price is based on the target volume of the document. The order price other than resulting from the pricelist is to be mutually agreed by the Customer and the Contractor prior to the order placement and is to be confirmed in writing (personally, by post, by fax or by electronic mail).

5. The Contractor may refuse to process the Customer's order on the day of the order placement.

6. The order is realised properly if the service is delivered by the Contractor within the agreed deadline and in the agreed way (by electronic mail, by post, courier, fax or personally in the premises of the Contractor or the Customer, depending on the prior agreement).

7. Confirmation of order delivery to the Customer is:

- written confirmation of receipt by the Customer
- proof of dispatch (by post or by courier) by the Contractor
- dispatch of the processed translation via electronic mail by the Contractor to the Customer

8. Upon the delivery of the service, the Contractor issues the invoice and the Customer is obliged to pay the agreed sum in due time.

3. Service flaws

In the event of faulty service, the Contractor's liability to the Customer is up to 100% of the order value, i.e. the value of the total discount for the Customer in the event of faulty service cannot exceed 100% of the order value.

4. Complaints

1. The Customer is obliged to notify the Contractor about any faults in the delivered service within 15 calendar days from the date of order delivery. After this time the right for discount compensation resulting from faulty realisation of the order for the Customer is waived.

2. All complaints are processed by the Contractor in cooperation with the Customer. In case of a conflict between the parties, such conflict is to be resolved by the sworn translator chosen from the list of sworn translators at the District Court in Łódź.

3. The costs of such an opinion are to be covered by the party that is proven to be wrong.

4. ArcusLink offers the warranty for its services for the period of 1 year (365 calendar days) counting from the date of service realisation. It is thus understood that ArcusLink is obliged to remove any flaws in the delivered service noticed by the Customer within one year from the service delivery. However the Customer is not entitled to any discount in case of notifying the Contractor about the fault after 15 days of the service delivery.

5. Renouncement of the concluded contract

1. In case when the Customer renounces the concluded contract, the Customer is obliged to pay the Contractor the price for the part of the order already realised to the day of the renouncement. The Contractor delivers to the Customer the order at the given stage of processing and invoices the Customer for the actually performed part of the service.

2. The Customer is obliged to cover the Contractor's costs beard in course of the order's realisation if the Contractor documents such costs.

6. Confidentiality

1. The Contractor is obliged to keep all materials and information submitted by the Customer in course of the order realisation confidential.
2. Any materials and information submitted by the Customer in course of the order realisation may be submitted further only to the direct subcontractors of the Contractor, i.e. to translators, proofreaders or consultants working on the order, in the degree necessary for adequate realisation of the order.

7. Final provisions

1. All issues not regulated by the General Terms of Cooperation of ArcusLink shall be regulated by the relevant Civil Code provisions, with reserve to Article 3 of this document.

2. The Customer agrees to receive from ArcusLink information and commercial offers.

3. The provisions of the General Terms of Cooperation are biding to both parties, unless they were modified upon different provisions stated in written cooperation agreement or in an agreement on the performance of a specific order.

4. The General Terms of Cooperation of ArcusLink Professional Translation take effect as of March 1st 2009.

 

 

Translation is always done in editor preferred by the Client, while the layout of the document is always identical to layout of the source document.
